RoxbyFit Liability Waiver and Terms of Service
Liability Waiver
I, the undersigned Participant (or parent/guardian if under 18), wish to participate in private or group fitness training sessions, classes, and related activities offered by RoxbyFit and Amelia Juniper-Grey (collectively, the “Releasees”).
1. Voluntary Participation and Assumption of Risk
I understand and acknowledge that physical exercise and training can be strenuous and involve inherent risks of serious injury, including but not limited to: muscle strains, sprains, tears, joint injuries, fractures, cardiovascular events (such as dizziness, fainting, abnormal heart rhythms, or, in rare cases, heart attack or stroke), and other musculoskeletal or cardiorespiratory issues. I recognize that not all risks can be foreseen.
I am voluntarily participating in these activities. I have been urged to obtain a medical examination from a qualified physician before starting. I represent that I am in good physical condition, have no undisclosed medical conditions that would prevent safe participation, and I assume full responsibility for any risks.
2. Release of Liability
I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE RoxbyFit, Amelia Juniper-Grey, their affiliates, owners, trainers, staff, agents, successors, and assigns (the “Releasees”) from any and all liability, claims, demands, actions, or causes of action whatsoever, including those arising from the negligence of the Releasees, for any injury, death, loss, or damage to person or property arising out of or in connection with my participation in the Activities.
This release applies to claims brought by me, my heirs, executors, administrators, assigns, or anyone on my behalf.
3. Indemnification
I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, suits, actions, damages, costs (including reasonable attorney fees), or liabilities brought by me or on my behalf arising from my participation in the Activities.
4. Medical Authorization and Responsibility
In the event of an emergency, I authorize the Releasees to seek and consent to necessary medical treatment (including first aid, CPR, AED use, and transport). I agree to assume all costs of such treatment and acknowledge that I should maintain my own health insurance. The Releasees are not responsible for any errors or omissions by third-party medical providers.
5. Equipment and Facilities
I agree to use equipment and facilities responsibly. I will be liable for any damage caused by my (or my family/agent’s) willful misconduct, gross negligence, or recklessness.
6. Additional Terms
I acknowledge that this Agreement is clear and unambiguous. It shall be interpreted according to its plain language and the purposes for which it is entered.
If any provision is held invalid, the remainder shall continue in full force.
This Agreement is governed by the laws of the state of South Australia. Any disputes shall be resolved in the courts of that jurisdiction.
I have read this entire document, understand it, and sign it voluntarily. No oral representations have been made to me.
Photo/Video Release
I hereby grant RoxbyFit and Amelia Juniper-Grey (collectively, “the Company”) irrevocable permission to use my name, likeness, image, voice, and any photographs, videos, recordings, or other media featuring me (“Media”) taken during my participation in RoxbyFit activities.
This permission includes the right to use, edit, alter, copy, reproduce, exhibit, publish, distribute, transmit, and display the Media in any and all media now known or hereafter devised, including but not limited to: websites, social media platforms (e.g., Instagram, Facebook, TikTok, YouTube), promotional materials, advertisements, brochures, newsletters, training content, and other lawful marketing or business purposes worldwide, without payment or other compensation to me.
I understand and agree that:
All Media will be the sole property of the Company and will not be returned.
I waive any right to inspect, approve, or have input on the finished product or how my likeness is used.
I waive any claims for royalties, compensation, or other payments related to the use of the Media.
The Company may use the Media in composite or modified forms, with or without my name.
I hereby release, hold harmless, and forever discharge the Company, its affiliates, agents, and assigns from any and all claims, demands, or causes of action (including invasion of privacy, defamation, or right of publicity) that I, my heirs, representatives, executors, administrators, or anyone acting on my behalf may have arising from the taking or use of the Media, to the fullest extent permitted by law.
I have read and fully understand this Photo and Media Release. I affirm that I am at least 18 years of age, or, if I am under 18, my parent/guardian has consented as shown by their signature below.
